KYGO HEALTH TERMS AND CONDITIONS

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Kygo Health LLC ("Company," "we," "us," or "our") governing your access to and use of the Kygo Health mobile application for iOS and Android (the "App"), the Kygo Health web application at app.kygo.app (the "Web App"), the Kygo Health website at kygo.app, including its blog and free tools (the "Site"), and all related services (collectively, the "Service").

BY CREATING AN ACCOUNT, DOWNLOADING, ACCESSING, OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE SERVICE.

2. General Wellness Product, Not Medical Advice

 

2.1 Wellness Product Classification

Kygo Health is a general wellness product designed to help you maintain or encourage a healthy lifestyle through nutrition tracking and health data correlation. The Service is NOT a medical device and is NOT intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

 

2.2 No Medical Advice

THE SERVICE DOES NOT PROVIDE MEDICAL ADVICE. All information, content, insights, recommendations, correlations, articles, and tools provided through the Service are for informational and educational purposes only. They are not substitutes for professional medical advice, diagnosis, or treatment, and using the Service does not create a doctor-patient or other healthcare professional relationship with us.

 

You should always:

• Consult with a qualified healthcare provider before making any health-related decisions

• Seek immediate medical attention for any medical emergency

• Discuss any dietary changes with your doctor, especially if you have existing health conditions

• Never disregard or delay seeking professional medical advice based on information from the Service

 

2.3 FDA Status

The Service has not been evaluated or approved by the U.S. Food and Drug Administration (FDA). It is intended for general wellness purposes consistent with FDA's policy for low-risk wellness devices and software functions.

3. Eligibility and Account Registration

 

3.1 Age Requirements

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

 

3.2 Account Registration

You do not need an account to read the Site or use its free tools. To use the App or Web App you must create an account with an email address and password, or with Sign in with Apple or Sign in with Google. One account works across the App and the Web App. You agree to:

• Provide accurate, current, and complete information during registration

• Maintain and promptly update your account information

• Keep your password secure and confidential

• Notify us immediately of any unauthorized use of your account

• Accept responsibility for all activities under your account

 

4. Description of Service

 

4.1 Core Features

• Food and drink logging by search, barcode scan, photo, voice, and typed description

• Saved foods, custom meals, and recipes

• Supplement tracking

• Weight tracking

• Integration with wearable devices and health platforms (Oura, Fitbit, Garmin, WHOOP, Apple Health, Android Health Connect)

• Correlation analysis between what you consume and your health metrics

• Personalized insights and recommendations, some of which are generated by AI (section 8.4)

• Progress tracking, trends, and reminders

 

4.2 Third-Party Services

The Service relies on third-party services. Your use of the ones you connect to or purchase through is also subject to their own terms:

• Oura: Oura Terms of Service and Privacy Policy (ouraring.com)

• Fitbit: Google Terms of Service and Privacy Policy, because Fitbit data is delivered through the Google Health API

• Garmin: Garmin Terms of Use and Privacy Statement (garmin.com). Data submitted through our Service is submitted to Kygo Health, not Garmin

• WHOOP: WHOOP Terms of Use and Privacy Policy (whoop.com)

• Apple Health: Apple's Terms and Conditions

• Android Health Connect: Google's Health Connect terms

• Apple App Store, Google Play, and Stripe for purchases (section 6)

 

Nutrition values come from Nutritionix, Edamam, Open Food Facts, and USDA FoodData Central. Photo recognition, supplement label reading, and AI insights run on Google Cloud Vertex AI inside our own private project, as described in our Privacy Policy. We are not responsible for the availability, accuracy, or functionality of any third-party service.

4.3 Service Availability and Changes

We may modify, suspend, or discontinue any part of the Service, add or remove integrations, and update our algorithms at any time. The App may install updates automatically. We do not guarantee that the Service will be available at all times or without interruption.

 

4.4 The Kygo Health Website, Free Tools, and Affiliate Links

The Site publishes articles, comparisons, and free interactive tools such as calculators and device comparisons. This content is general information about nutrition, wearables, and health metrics. It is not personalized advice, it is not a substitute for professional medical advice, and section 2 applies to it in full. Tool results are estimates based on the figures you enter and on published research, and they are not measurements of your body.

Research summaries and product information on the Site reflect the sources available when we wrote them and may become out of date. Where we cite a study or a manufacturer specification, we link to the source so you can check it yourself.

Some links on the Site are affiliate links, including links to Amazon. As an Amazon Associate we earn from qualifying purchases. If you buy through one of those links we may receive a commission at no additional cost to you. We may also publish paid placements or sponsored mentions, which are labeled as such. Compensation does not change our testing, our rankings, or what we report. We are not the seller of any third-party product, we do not warrant it, and any purchase you make is governed by the terms of the merchant you buy from.

5. Wearable Device Integration Terms

 

5.1 Authorization and Consent

To use a wearable or health platform integration, you must authorize Kygo Health to access your data, through OAuth 2.0 for cloud services or through the permission prompts for Apple Health and Health Connect. You may revoke this authorization at any time through the respective platform's settings or in App Settings. When you disconnect a cloud service, we stop retrieving new data and delete the data we hold from that provider, as described in our Privacy Policy.

 

5.2 Oura Ring Integration

By connecting your Oura Ring, you acknowledge and agree that:

• We access your Oura data solely to provide health tracking and correlation analysis features

• We comply with the Oura API Agreement and will not use your data for advertising or sale to third parties

• Oura may collect usage data related to our API access

• Your Oura data is kept only as long as it is needed for the features you use, and no longer than the periods stated in our Privacy Policy

• Disconnecting your Oura Ring will stop data collection and trigger deletion of your Oura data from our systems, and we delete your Oura data within 72 hours of a deletion request

 

5.3 Fitbit Integration (via the Google Health API)

By connecting your Fitbit device, you acknowledge and agree that:

• Fitbit data is accessed through the Google Health API using Google OAuth 2.0, and our access to and use of it complies with the Google API Services User Data Policy, including its Limited Use requirements

• We will never sell, lease, or transfer your Fitbit data to advertisers or data brokers

• Your data is used solely for health and fitness features within the Service

• You may revoke access at any time in your Google Account permissions (myaccount.google.com/permissions) or in App Settings

• Connections made through the older Fitbit Web API stop syncing once Google retires that API (September 2026) and must be reconnected through your Google Account to keep syncing

 

5.4 Garmin Integration

By connecting your Garmin device, you acknowledge and agree that:

• We comply with the Garmin Connect Developer Program Agreement

• Data submitted through our Service is submitted to Kygo Health, not Garmin; Garmin has no responsibility for data in our possession

• We retain your Garmin data only as long as needed for the Service's functionality or as you consent

• You may revoke access at any time via Garmin Connect settings or in App Settings

 

5.5 Apple Health Integration

By connecting to Apple Health (HealthKit), you acknowledge and agree that:

• We only access HealthKit data types you explicitly authorize

• HealthKit data is used solely for health and fitness features

• We will NEVER use HealthKit data for advertising or marketing purposes

• We will NEVER sell HealthKit data to third parties

• We will NEVER share HealthKit data for data mining purposes unrelated to health

• We will NEVER write false or inaccurate data to HealthKit

• With your separate permission, we write the nutrition and hydration you log in Kygo back to Apple Health

• You may revoke permissions at any time via iOS Settings > Health > Data Access & Devices

 

5.6 Android Health Connect Integration

By connecting to Health Connect, you acknowledge and agree that:

• We only read the data types you grant, and only in the background or for past dates where you grant those permissions separately

• Health Connect data is used solely for health and fitness features and is never used for advertising

• With your separate permission, we write the nutrition and hydration you log in Kygo back to Health Connect

• You may revoke any of these permissions at any time in Android Settings

 

5.7 WHOOP Integration

By connecting your WHOOP device, you acknowledge and agree that:

• We access your WHOOP data via OAuth 2.0 authentication solely to provide health tracking and correlation analysis features

• We comply with the WHOOP API Terms of Use, including all restrictions on data use, storage, and disclosure

• We will never sell, lease, license, or syndicate your WHOOP data to any third party, even with your consent

• Your data is used solely for health and fitness features within the Service

• You may revoke access at any time via your WHOOP account settings or in App Settings

 

6. Plans, Purchases, and Payment Terms

 

6.1 Free Use and Kygo Health Pro

The core of the Service is free: food logging by search, barcode, voice, and typed description; saved foods and meals; weight tracking; wearable connections; correlations; insights; and trends. Kygo Health Pro ("Pro") is a paid plan that unlocks additional features, currently photo logging, supplement tracking, and writing nutrition back to Apple Health or Health Connect.

Which features require Pro depends on when your account was created. Accounts created before our current plan structure keep the features they already had. The Service marks any feature that requires Pro for your account, and we may change what Pro includes over time; we will not remove a feature you have paid for during a period you have already paid for.

6.2 Free Trial

Eligible new accounts may start a free trial of Pro, currently 7 days, when they choose a subscription. The length of the trial, and whether a trial is offered at all, may change at any time; the terms shown to you at the moment you start a trial are the ones that apply to it. When the trial ends, the subscription you selected begins and you are charged at the price shown when you started it, unless you cancel before the trial ends. Trial eligibility is determined by Apple, Google, or our billing provider, and a trial is generally available once per person.

6.3 Subscriptions

• Pro subscriptions are billed monthly or annually, as selected at purchase, and renew automatically at the same price and term until you cancel

• Purchases in the App are processed by the Apple App Store or Google Play under their terms; we never see or store your payment details

• Purchases on the Web App are processed by Stripe through our billing provider, RevenueCat; Stripe receives your card details directly

• To cancel: on iOS, use your App Store subscription settings; on Android, use Google Play subscriptions; for a web purchase, use Manage Subscription in Settings. Cancellation takes effect at the end of the current billing period, and deleting your account does not cancel a store subscription

• Prices may change; we will give at least 30 days' notice through the store or by email before a change applies to your renewal

• Fees are non-refundable except as required by law. Refunds for App Store and Google Play purchases are decided by Apple and Google under their policies; for web purchases, contact info@kygo.app

 

6.4 Lifetime Purchase

We may offer a one-time Lifetime Pro purchase to a limited number of accounts. It is not a subscription and does not renew. "Lifetime" means for as long as Kygo Health operates the Service; it is tied to your account and cannot be transferred. An existing subscription is not cancelled automatically when you buy Lifetime, so cancel it with the store to avoid a further renewal. Refunds follow the store's policy. We keep a minimal record of a lifetime purchase after account deletion, as described in our Privacy Policy, so that refunds and the seat limit can be honored.

7. User Responsibilities and Acceptable Use

 

7.1 Your Responsibilities

• Provide accurate food and nutrition information

• Use the Service for personal, non-commercial purposes only

• Comply with all applicable laws and regulations

• Consult healthcare professionals before making significant dietary changes

 

7.2 Prohibited Activities

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose

• Interfere with or disrupt the Service's functionality

• Attempt to gain unauthorized access to any part of the Service or to another user's account

• Reverse engineer, decompile, or disassemble the App

• Use automated systems (bots, scrapers) to access the Service

• Upload content you do not have the right to share, or that is unlawful or harmful

• Resell or redistribute any part of the Service, including republishing Site articles or tools

 

8. Data Accuracy and Disclaimers

 

8.1 Nutritional Data Accuracy

Nutritional information is sourced from third-party databases (Nutritionix, Edamam, Open Food Facts, and USDA FoodData Central). While we strive for accuracy, we do not guarantee that nutritional data is complete, error-free, current, or applicable to all product variations, brands, restaurant dishes, or homemade recipes. Verify nutrition information independently when accuracy is critical to you.

 

8.2 Health Metric Accuracy

Health data from wearable devices and health platforms is provided by their manufacturers. We do not guarantee the accuracy, reliability, or completeness of this data. Device accuracy may be affected by placement, user activity, environmental conditions, and individual physiological variations.

 

8.3 Correlation Analysis Disclaimers

IMPORTANT: Correlations presented by the Service are based on statistical analysis and DO NOT establish causation. Correlations may be coincidental, influenced by confounding variables, not applicable to all individuals, or based on limited data. Do not make significant health decisions based solely on correlations shown in the Service.

 

8.4 AI-Generated Content

Photo recognition, supplement label reading, the interpretation of spoken and typed food descriptions, and personalized insights are produced by automated systems, including AI models. They can misidentify a food, misread a label, estimate a portion incorrectly, or draw a conclusion that does not apply to you. Always review what the Service proposes before you save it, and treat AI insights as suggestions for you to evaluate, not as facts or medical advice.

9. Intellectual Property and Your Content

 

9.1 Our Rights

The Service and all its contents, features, and functionality, including Site articles, tools, and graphics, are owned by Kygo Health LLC and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may quote a short excerpt of a Site article with attribution and a link, but you may not republish an article or tool in whole or in substantial part without our written permission.

 

9.2 Your Content

You retain ownership of the content you create or submit to the Service, including food logs, custom foods, meals, recipes, supplement regimens, notes, photos, and support requests ("User Content"). You grant us a worldwide, royalty-free, non-exclusive license to store, process, reproduce, and display your User Content solely to provide, secure, and improve the Service. This license ends when your User Content is deleted from our systems, except for aggregate, non-identifying statistics that cannot be traced back to you.

 

9.3 Feedback

If you send us feedback, suggestions, or ideas, you grant us a perpetual, irrevocable, royalty-free license to use them for any purpose without compensation to you.

 

10. Privacy

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our Privacy Policy. It is available within the App, on the Web App, and at kygo.app/privacy-policy. Our Consumer Health Data Privacy Policy, required by Washington and Nevada law, is at kygo.app/consumer-health-data.

11. Disclaimers and Limitations of Liability

 

11.1 "AS IS" Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION.

 

11.2 No Warranty of Results

We do not warrant or guarantee any specific results from using the Service, including weight loss or gain, improved health metrics, enhanced athletic performance, better sleep quality, or disease prevention.

1.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KYGO HEALTH LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITY, PERSONAL INJURY, OR HEALTH COMPLICATIONS ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR ONE HUNDRED U.S. DOLLARS ($100.00).

 

11.4 Third-Party Service Provider Disclaimers

These Terms disclaim all warranties on behalf of third-party service providers, including Oura, Google, Fitbit, Garmin, Apple, WHOOP, and others, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Third-party service providers are excluded from all liability for consequential, special, punitive, and indirect damages.

 

11.5 App Store and Google Play

These Terms are between you and Kygo Health LLC, not Apple or Google. Apple and Google are not responsible for the App or its content, have no obligation to provide maintenance or support for it, and are not responsible for any claim relating to the App, including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the iOS App and may enforce them against you. Your use of the App must also comply with the applicable store's terms of service.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Kygo Health LLC, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from your use or misuse of the Service, your violation of these Terms, your violation of any rights of any third party, your reliance on information from the Service, or health complications arising from dietary changes made using the Service.

13. Termination

 

13.1 Termination by You

You may delete your account at any time under Settings > Privacy & Data > Delete Account, or by emailing info@kygo.app. Uninstalling the App or signing out does not delete your account or your data. Deleting your account does not cancel a subscription bought through the App Store or Google Play; cancel it with the store first (section 6.3).

 

13.2 Termination by Us

We may suspend or terminate your access immediately, without notice, for violation of these Terms, suspected fraudulent activity, non-payment of fees, legal or regulatory requirements, or behavior that harms or could harm Kygo Health LLC or other users.

13.3 Effect of Termination

Upon termination, your right to access the Service immediately ceases. Your personal data is deleted as described in our Privacy Policy: immediately from our live systems, and from backups within 30 days, except for the minimal purchase record described there. Upon request, we will confirm in writing that your data has been deleted. Provisions that by their nature should survive termination will survive.

 

14. Dispute Resolution

 

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law provisions.

 

14.2 Informal Resolution

Before filing a claim, you agree to contact us at info@kygo.app to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 60 days.

 

14.3 Arbitration Agreement

PLEASE READ CAREFULLY. You and Kygo Health LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall be settled by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

CLASS ACTION WAIVER: You and Kygo Health LLC agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

 

15. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated through in-app notifications, email to your registered address, and by updating the "Last Updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms. If you do not agree to any changes, you must stop using the Service.

 

16. Miscellaneous Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kygo Health LLC.

 

Severability: If any provision is found unenforceable, the remaining provisions remain in full force.

 

Waiver: Our failure to enforce any provision shall not be deemed a waiver of that provision.

 

Assignment: You may not assign these Terms without our prior written consent.

 

Independent Contractors: No partnership, agency, or joint venture is created by these Terms.

 

Force Majeure: We shall not be liable for failures due to circumstances beyond our reasonable control.

 

Electronic Communications: You agree that notices and other communications we provide electronically satisfy any legal requirement that they be in writing.

18. Acknowledgment and Acceptance

BY CLICKING "I ACCEPT," CREATING AN ACCOUNT, OR USING THE SERVICE, YOU ACKNOWLEDGE THAT:

• You have read and understood these Terms

• You agree to be bound by these Terms

• You are at least 13 years of age

• You understand this is a wellness product, not a medical device

• You will not rely solely on the Service for medical decisions

• You accept all risks associated with using the Service

• You understand the limitations and disclaimers
